This Privacy Policy describes the manners in which Otter Links, LLC (“Otter Links”, “Company”, “we”, “our”, or “us”) values its users (“you” or “your”) and its users’ privacy. It governs how Otter Links collects, uses, discloses, maintains, and protects information in connection with its website(s), mobile website(s), mobile application(s), browser extension(s), and any related services (“Services”) that refer to or link to this Privacy Policy. The Services may use “cookies” to enhance a user’s experience. A user’s web browser places cookies on the hard drive for record-keeping purposes and sometimes to track information. Third Parties Collecting from Company: Otter Links may use analytics services provided by third parties. These third parties use cookies and other technologies to collect data about usage of Services over time. This information is transmitted to and stored by analytics providers, who use this information for purposes such as evaluating a user’s usage of a website, compiling reports on website activity for website operators, providing the Company with information for customer service and product development purposes, and providing other services relating to activity on the Services and internet usage. In some jurisdictions, such as California, certain types of information may be considered “sensitive personal information” including:

Sensitive Personal Information: Demographic information, such as gender, age, household income, or marital status, only to the extent a user provides this information in a survey response that is identifiable to the user; and precise geo-location data, to the extent a user has configured their devices to disclose such information.

Otter Links only uses sensitive personal information to provide Services to user and does not collect, use, or disclose any sensitive personal information for the purpose of inferring characteristics about user. Otter Links does not “sell” or “share” sensitive personal information or use sensitive personal information for “target advertising” as defined in U.S. state privacy laws.

2. Usage of Information

Otter Links adopts appropriate data collection, storage and processing practices, and security measures to protect against unauthorized access, alteration, disclosure or destruction of user’s personal information and data stored in our Services. Otter Links uses information collected from user for the following commercial and business purposes:
To send periodic e-mails
Otter Links may use email addresses provided by users to respond to users’ requests or questions. If a user opts-in to Company’s mailing list, the user will receive emails that may contain Company news, deal alerts, updates, related product, or service information. User may unsubscribe from receiving future emails at any time.

Otter Links may process users’ registrations, validate users’ email account(s), manage account preferences, send administrative notices, and provide membership support.

Otter Links may personalize services so that it is more likely to be of interest to a user by identifying usage trends and performing statistical analyses.

Otter Links will not sell, trade, or rent user’s personal information to others. However, our Company may share generic aggregated demographic information not linked to any personal identifying information with merchants, trusted affiliates, and advertisers for the purposes outlined above. Further, Otter Links may disclose information collected from users for the following commercial and business purposes:
  • Otter Links may disclose any information disclosed publicly by a user, in any of the Services, such as in a public forum. Otter Links is not responsible for any information disclosed by a user in public forum, and strongly discourages the public disclosure of personal information in any of the Services.
  • Otter Links may disclose user’s information with its agents, contractors, service providers, merchants, and partners who are providing services on behalf of our Company.
  • Otter Links may disclose user’s information with user’s consent.
  • Otter Links may disclose user’s information, including personal information, to the extent permitted by applicable law.
  • Otter Links may disclose user’s information in connection with, or during confidential negotiations of, any proposed or actual merger, purchase, sale, or any other type of acquisition of all or any portion of our Company’s assets, conveyance or transfer of all or a portion of business to another company.

4. User’s Communication

Our users are encouraged to maintain the accuracy of the information held in a user’s account. Account updates may be provided by logging into the membership account and updating information in the Settings.

A. Communication Preferences

E-mail Marketing: Otter Links may send periodic electronic communications and direct mailings when a user signs up for an account. A user can opt out of receiving promotional communications at any time by following the instructions provided in those communications to unsubscribe, modifying the settings of the account, or contacting our Company through the Services. If opting out of receiving promotional communications, Otter Links may continue to send non-promotional emails and other types of communications as permitted by law, such as service emails relating to the ongoing business relationship, or service-related announcements that affect a user’s account.

Mobile Application Notifications: When using Otter Links’s mobile application, a user’s preference for receiving push notifications and other mobile alerts can be configured in the settings of a mobile device. A user can stop all collection of information by the mobile application by uninstalling the mobile application or updating the setting of a mobile device.

SMS Messaging: If a user consents to receive SMS messages through a mobile phone number, Otter Links may send promotional or non-promotional messages. A user can opt out of receiving such messages at any time by modifying the settings of the account, or by contacting our Company through the Services.

5. Your Privacy Rights

All users have certain rights in relation to personal information under applicable laws, subject to certain exceptions. Users that are residents of California, Colorado, Connecticut, Utah, and Virginia have specific rights under state privacy laws with respect to personal information that is collected. The disclosures required by law for such rights are included below.
Right to Access: A user has the right to know the specific personal information collected, used, disclosed for a business purpose, and sold or shared for the purposes of targeted advertising. Right to Correct: A user has the right to request that Otter Links correct any inaccurate or incomplete personal information collected or maintained, subject to certain exceptions. A user has the ability to correct information provided in account settings of Services.
Right to Opt-Out: Certain disclosures of information to agents, contractors, service providers, merchants, and partners for targeted marketing purposes may be considered “selling”, “sharing”, or processing for the purpose of “target advertising” under applicable U.S. state privacy laws. A user may opt-out of having personal information used or disclosed in this way. To the extent a user opts-out of certain disclosures, Otter Links may be unable to offer certain services which require such disclosures.
Right to Non-Discrimination: Otter Links will not discriminate against a user for exercising any rights. Unless otherwise permitted by applicable law, our Company will not do any of the following because a user requests to know, access, correct, or delete information, or opt out of its sale or sharing: (i) deny a user goods or services; (ii) charge a user different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; (iii) provide a user a different level or quality of goods or services, or (iv) suggest that a user may receive a different price or rate for goods or services or a different level or quality of goods or services.
Only a user or someone legally authorized to act on a user’s behalf, may make a verifiable consumer request related to personal information. For any agent making a request on a user’s behalf, Otter Links may require proof that a user granted authority to the agent.

A. California Privacy Rights

Section 1798.83 of the California Civil Code, also known as the Shine the Light Act, provides that companies must give consumers a list of personal information that is shared with any third parties, the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. B. Children’s Privacy

Otter Links Services are intended for adults 18 years of age or over. For that reason, the Company does not knowingly collect, sell, or share personal information of users under 13 years of age. If you are a parent or legal guardian of a child under 13 years old and believe that your child has provided personal information to our site, you may contact us at legal@otterlinks.com to request deletion of your child’s personal information.

C. Retention of Data

Otter Links may retain information about a user for as long as it is necessary to fulfill the purposes described in Section 2. Some of this information may be retained in our Company’s systems even after a user requests deletion if an exception applies, or in order to comply with obligations under applicable law, collect fees owed, resolve disputes, enforce legal rights, undertake any investigations necessitated by the foregoing, or otherwise use internally in a lawful manner that is reasonably aligned with a user’s reasonable expectations or compatible with the context in which the information was provided.

D. Third-Party Advertising

A user can access third-party features, such as offers and advertisements, directly from links on the Services and/or from emails or texts sent by or on behalf of the Company. When interacting with these advertisements, a user is providing information directly to third parties and/or directing Otter Links to send information to third parties. This Privacy Policy does not apply to the information sent to or collected by third parties when interacting with these advertisements. Otter Links cannot control the privacy practices of third parties and is not responsible for such practices. Advertisements appearing in the Services may be delivered to users by advertising partners who may set cookies. These cookies allow the ad server to recognize a user’s device each time they send you an online advertisement, and to compile non personal identification information about a user’s device. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This privacy policy does not cover the use of cookies by any advertisers.

This Privacy Policy is current as of the effective date set forth below. Otter Links reserves the right to change this Privacy Policy from time to time consistent with applicable privacy laws and principles and practices in relation to personal information.
